Nicholas Marshall
Nicholas practises in a range of commercial disputes including sale of goods, breach of warranty claims; shareholder/partnership disputes; licensing law; insurance litigation; intellectual property; carriage of goods by road (national and CMR); disputes with HM Revenue & Customs; challenges to procurement decisions; and professional negligence.
Nicholas has represented clients interests in (1) the High Court (including the Administrative Court, Commercial Court, Patents Court and Technology and Construction Court); (2) the County Court; and (3) a variety of specialist Tribunals and Committees (including the VAT and Duties Tribunal, Appeals and Licensing Committee, Appeals Tribunal and HM Coroners Court). Nicholas' recent cases include a five week trial in the Technology and Construction Court; a four day trial in the High Court; a two day hearing before the VAT & Duties Tribunal; and a hearing in the Patents Court.
Nicholas has extensive experience of litigation arising out of the carriage of goods by road, both in a national and international context. Nicholas is fully conversant with the CMR, the Road Haulage Association's Terms and Conditions of Carriage, the Freight Transport Association Terms and Conditions of Carriage and the British International Freight Association's Standard Trading Conditions and has conducted a number of high value cases involving (1) allegations of wilful misconduct; (2) seizure or forfeiture and legal process; (3) carriers liens; (4) limitation periods; (5) Acts of God; and (6) insufficient or improper packing.
